We are pleased that your firm is able to accept employment to represent the interest of the Insured with respect to the above-referenced matter. The nature of the claim is as follows: The Insured has been sued in a lawsuit by her neighbor who alleges that her property encroaches on his property, specifically her deck and the back side of her house, her HVAC unit, and several

shrubs. A survey was not done at closing and there is no survey exception. Insured is stating that

the deck, hvac units, and shrubs were on the property when she bought it in 2006 and has submitted her 2006 appraisal as proof of this. The Plaintiff had a survey done that indicates that the Insured's property is encroaching onto his land. The scope of your representation is to represent the Insured in the lawsuit.
