Marimar,

I hope all is well! The new year started off with a brutal flu (first ever in my life) that knocked me out for 10 days. The hearing is scheduled for tomorrow at 9AM and I will be in attendance. I know we didnt want to unilateral ask the Judge for a court order regarding the impervious surface issue, but I intend to do so tomorrow. As for the survey, I still have not heard back from the surveyor, but I anticipate that they cant finalize anything until we have a variance appeal or court order as we previously discussed. Regarding the survey cost(s), the surveyor misspelled my name so we never received the attached invoices until I sent a specific request (even then, my name spelling had to be confirmed via phone); do you want me to bill Stewart for those or do you want to send checks directly?

The insured is updated and knows she does not need to attend the hearing. She is also aware of all the dates I emailed/called opposing counsel trying to get the transcript and a decision on the variance/court order issue. Im not sure if Sweatman is delaying this on purpose to delay moving his fence (or just frustrate the insured), but I am very much done with their games, and the Judge will be made aware of the same.

I can call you after the hearing if youd like. If you have any questions or need anything, let me know.
