Sarah,

Gaddy sent over the formal proposal a few days ago and it has been approved. We will have it scheduled. Further, I just spoke with the Judges staff attorney and the hearing has been cancelled. Judge Irwin, as you might recall, mentioned at the trial that he was a property attorney for the County before being a Judge so he knew why there was such a significant period of time to formalize the survey requirements and settlement. He also mentioned that our estimated timeline of 4-6 weeks is our estimate, but the actual permitting and topography portion of the re-plat is out of our hands. We will do what we can to expedite.

I have been in communication with Gaddy each week and providing him additional details to submit the formal proposal today. As for the hearing, you will not need to be present. Its a status hearing and I will email the Court the delay with the survey complexities and County and City requirements causing the delay due to their recent ordinances and zoning rules. The work Gaddy would be doing is re-platting the property lines which, given the location of the homes (both physical and in the City of Brookhaven/unincorporated DeKalb County), which requires topography scans, impervious surface measurements/inspection to ensure they are below 35%, permitting to change the tax assessor maps, and a three (3) page compilation of the original survey, topography, and proposed re-platting/subdivision survey that will then become the controlling plat for both properties.

Again, it is complex and the technical aspect of the equipment used would best be explained by Gaddy. He estimates the surveys to take roughly 6 hours per property.

Can I please get an update?

There has been no response to my questions for over a week and my voicemail was not answered.

Its my understanding nothing has been scheduled with Gaddy and at this point in time I will have to request be absent from my job for the upcoming court hearing for which we have no survey?
