Hi Sally,

I spoke with Sarah Zeeman and she said she needs more time to review the document. She is concerned that if she signs the encroachment agreement she will be giving up all other affirmative actions and defenses in the lawsuit so she would like more time to review. Please hold off on contacting the Plaintiffs attorney and the other attorney until after Sarah calls you next week. If she is not in favor of the encroachment agreement after fully reviewing it please let me know.

Amy, do you have time for a quick call on this one today?

I talked to the insured about the encroachment agreement and it does not appear she wishes to try and resolve the litigation through the proposed encroachment agreement. She has also instructed us not to speak with opposing counsel until further notice as she also has an attorney with her homeowners insurance that she would like us to coordinate litigation strategy with.
