Marimar,

I apologize, this was buried in my emails - I was out for a little due to the death of my twin brother and just now catching up on everything.

We have been back and forth since mediation and I received the attached settlement proposal this afternoon. In my opinion, this is a great proposal. I understand the insured wants the entire fence moved back to where it was, which might prove difficult to negotiate a resolution, but, based on my call with opposing counsel, they may be willing to give 2 panels of fencing as opposed to one so at least she will get a portion of the yard back. Importantly, it will completely cure our encroachments and give access to maintenance etc. for the HVAC and side of the house. $6,000.00 seems a bit high, especially with the cost of surveying both lots and the potential requirement to obtain variances, but given the overall cost of this case it seems negligible. It's also my understanding that Ms. Zeeman, per her private counsel, might be able to contribute some funds.

I know it's extremely detailed and somewhat difficult to ascertain where the lines would be. I can do a property visit to confirm we have the required space and schedule a call with you to overview the proposal.
