Susanne,

Mediation was - eventful and over 9 hours. We gave an initial proposal that was an easy, clean solution and Plaintiff agreed to essentially every term without taking a penny. Ultimately, they wanted numerous stipulations on the easement area and the "access" was wholly insufficient to truly access the side of the insured property. As we went back and forth, Plaintiff's counsel said it might just be easier to purchase property running from the original location of the fence (approximately 2.8 feet over) all the way to the road. This would eliminate the need for an easement and would resolve the encroachments. That being said, we left the mediation "open" to further discuss today. When we all left, I had $2,500 on the table and insured's other counsel did not yet have approval for any contribution. I have followed up with the insured's homeowner's insurance counsel today to request contribution. I believe we can get this fully resolved for $5,000.00. However, this will also require us to get permission from the City of Brookhaven and we will need to have the legal description for the Property updated with corrective deeds executed.

The easement/encroachment agreement seemed very straightforward and Plaintiff's ridiculous requests were the only reason we don't already have an agreement signed. I am about to call opposing counsel to further discuss and will update you.
