Good afternoon Brett.
I enjoyed meeting you as well. Thank you for your excellent ideas and input at the mediation yesterday. Your technical knowledge and creative solutions got the parties much closer than I anticipated we would be. I could tell that Ms. Zeeman was particularly impressed with you.
I have spoken with the Travelers adjuster. I am not coverage counsel, so please understand I am just the messenger here. Travelers has determined that the claims asserted against Ms. Zeeman are not covered under the terms of her homeowners policy. Although Travelers will agree to continue to defend under a reservation of rights, Travelers cannot authorize any contribution toward settlement. And while it might appear to make sense that Travelers could avoid defense costs by making such a contribution, there is no way that the adjuster can justify those payments. In short I do not have any settlement authority, nor do I anticipate having any.
I am optimistic that plaintiffs counsel will appreciate there is only so much the title insurer can contribute toward resolution and that you can convince her that Mr. Sweatman should accept less than $5000 to transfer property that he never considered his until this dispute arose.
Please let m know if there is anything we can do to assist in trying to resolve this matter. If the thought is that George Reid should get involved, I can certainly call him.

It was a pleasure meeting you in person yesterday. I understand we were very close to a full resolution and left the last proposal open. We arent that far apart and I was wondering if you have had a chance to speak to your adjuster regarding a contribution? Prior to mediation you mentioned they might throw in some money just as a cost of litigation. We left $2,500.00 on the table and I believe we can get the entire case solved for $5,000.00. Please let me know.
