I hope all is well with you. I am emailing with regard to the hearing on Monday and the settlement in general. The delay is due to DeKalb County and City of Brookhaven requirements for the surveyor which is far more extensive, with topography scan requirements, than a standard survey. That being said, the surveyor only recently was able to put together our proposal which included all the permitting requirements and topographical scans for submission of the survey/plat to DeKalb County for recording and ensuring that the impermeable surface requirements have been met so that the tax maps can also be amended. I understand that it has been a few months since our settlement, but our entire settlement agreement requires the incorporation of the new plats and approval through the County.

We received a timeline of 2 weeks for the survey and an additional 2-3 weeks for the topography review and permitting process at which time the settlement can be finalized.

That being said, we would respectfully request to be excused from the calendar. I am also on a trial calendar for an older case in Fulton County starting Monday, but I believe all counsel, copied hereto, would agree that the settlement requires the survey and the parties were unaware of how extensive this specific survey would be.

If the Court is amenable to removing this matter from the calendar, please let us know. Additionally, if you or Judge Irwin has any questions, please let me know.

My name is Joe Sibley and Im one of the law clerks here in DeKalb. Judge Irwin asked me to do a little extra follow-up on the status of the settlement documents.

Hes of the strong opinion that youve had more than enough time to prepare those and that if they dont show up soon hell be setting this down for a status hearing the week of August 26 where he will endeavor to identify the cause of the delay.

So where are we? Are the documents in the final signing stages or will this need further court attention? Hed like a date certain for when he can expect something, and the sooner the better.
