Fence to be moved back to its original location, approximately; fence shall be owned by Sweatman Property Sweatman Property agrees to remove fence post closest to the Zeeman boundary and the new fence shall start from the gate post In the event the fence is ever removed, Zeeman Property has the right to replace it in its relocated location Exclusive easement from Zeeman Property line to fence; Zeeman Property required to maintain easement area; Sweatman Property shall maintain fence Zeeman Property shall be entitled to tie into the fence; this includes both the rear and front sections of the fence Encroachments shown on Zeeman Survey, as amended, are permissible; in the event the deck encroachment is cured, it shall no longer be permissible Zeeman easement shall extend from the relocated fence to the road which easement area shall be limited to an access easement for Zeeman Property access to the backyard/fence gate, HVAC maintenance, replacement, and/or repair Zeeman Property waives rights to any claim of adverse possession Zeeman Property shall not erect any improvements in the easement area. However, Zeeman Property shall have the right to have water mitigation (e.g. drainage system) installed. In the event a contractor with expertise in water runoff/mitigation/remediation recommends that shrubbery and/or the like be installed so as to further mitigate the runoff from the Sweatman Property, the Zeeman Property shall be entitled to install the same pursuant to the plans of the aforementioned licensed contractor The cameras located on the Sweatman Property shall not be directed at the Zeeman Property; by way of further explanation, the cameras located on the Sweatman Property shall be fixed to surveillance of only the Sweatman Property Mutual Non-disparagement; Confidentiality provision; anti-harassment provision Indemnification provision Sweatman Property can’t change the current flow of water
