Are you free for a call on this matter today? As discussed in prior emails, our strongest defense is adverse possession which we will argue and seek a directed verdict on. With trial coming up on Tuesday, we have everything prepared and I have been working with the insured's private counsel to make sure that the case law we need, and jury charges, are included in the PTO, jury charges, motion(s), etc. We actually managed to narrow down the exhibits from over 2100 to under 50 - this was a feat in itself as I am sure you can imagine; we can discuss more on the call.
I will be in attendance and private counsel is taking the lead on opening/closing statements, direct/cross examination, and oral motions aside from the motion for a directed verdict as to the alleged encroachments.
I have a 2-3PM call and then can be flexible after that.
