Re Request For Update Stgc 328015 Zeeman 1¶

I just spoke with Tim Mitchell, insurance counsel for Plaintiff, and have been back and forth with Lisa for weeks now trying to get a clean copy for review; she keeps saying I will have it tomorrow and I havent gotten it. I just called her as well and she and Plaintiff are having a meeting tomorrow to finalize it and insurance counsel said he will be on the call and make sure we have the clean copy for final review by tomorrow.

I will stay on top of this and let you know when I receive it.

As for the alleged code violations, the insured is still refusing to provide the same. I am taking the position that it is a non-issue because the effective date of the settlement, which contains language about not making harassing claims to the City, is the date of execution.

I have reached out to opposing counsel and had a call with Sweatmans insurance counsel he too wants to put this matter to rest and is putting pressure on Lisa and Sweatman to get us the final agreement. He also doesnt understand why both sides are prolonging this resolution it was a very productive call. Lisa said she would have me a clean copy of the agreement last week, but I havent received it. I am following up again now and will give her a call this afternoon if I dont receive a response from her. Hopefully we can get the clean copy today.

Side note: both Lisa and insurance counsel are asking why we cant provide the list of alleged code violations, but insurance counsel doesnt seem to see those as a holdup because the settlement waives all alleged violations upon execution; the effective date is the date of execution.
