Eric,

Sorry for the slight delay; the meeting went late and I had Court all day today. The meeting went well and, aside from the surveyor getting frustrated and telling everyone they were absolutely ridiculous, it remained calm and all issues were addressed. Based on what the surveyor said, it would not surprise me if we get an additional invoice. As for the topography, the surveyor is sending the CAD file to the insured for review as she requested. We went over the Court Order route and variance route and there appeared to be a consensus between the insureds private counsel, myself, and the surveyor that it was the best option. That being said, the opposing party has the final decision and the Court Order on deadlines gives them until the 6th to let us know. We did learn that even with the Court Order, the city and county still review the plat; the difference is that it is his opinion that they have no objections and it gets pushed through within a couple weeks. The variance/appeal route was noted as being at least 6 months. Another option was brought up which was counsel having an informal meeting with the city zoning and planning to see what they would need and how they would treat a court order. In my opinion, that could open a can of worms, but the surveyor was informed that the city is, to no shock, very much aware of the issues between the properties.

I was supposed to have the final survey and updated legals back by EOD today; I havent received them yet. As soon as I do, I will send them your way.
