I just followed up with him. He had it put together and was finalizing it. I would expect it this week.

It's been over 65 days since the survey was performed.
The Engineer can't finish the report and we can not get repair estimates until the survey is complete.

As for increased water run off, that needs to be handled through your other counsel.
I know you prefer not to do it but it would be easier if you emailed us all at once. It is hard to know what is being sent to just us vs. what is being sent to everyone. It is all attorney-client privilege regardless.

Is sweatman going to be allow access

Over the weekend he added more dirt & elevation to direct water
From the front corner of his home into my hvac / foundation

I can only advise you as to title and we have not seen the survey yet so it is hard to give you advice. From a title perspective, the small encroachments from your house onto his property would likely be allowed to stay under some sort of encroachment agreement. From a title perspective, you are fighting over very little.
I can't advise you as to anything else; you should reach out to your private counsel on that. However, neighbor disputes can get very ugly and all of us attorneys get to go home at the end of the day. You still need to live next to each other unless one of you moves. It is always something to remember.

The sewer line and easement runs from the manhole through 1/3rd of my backyard into the man hole in the far corner of Sweatman's backyard if that helps.

As to the sewer easement, we only found one manhole but will show the location as best we can and reference the prior surveys, which look to be consistent with what they saw in the manhole. However, he states they did not pull the lid on the manhole, it's in the middle of the street. It looks to be consistent in all ways they could tell without blocking traffic and popping the manhole cover.
Once they do a check today, they can finish the survey.
