ORDER SETTING DEADLINES
The parties having announced a full settlement of all issues on May 28, 2024; and the Court having regularly requested status updates from counsel; and the Court having held a status hearing on January 13, 2024; the Court sets the following deadlines to ensure expeditious closure of the Case:
1.
The Defendant shall provide the updated survey to Plaintiff by close of business on January 16, 2025.
The Property shall be marked/staked consistent with survey no later than January 23, 2025. Counsel acknowledge the possibility that the new survey may not result in any alteration to the marks/stakes placed in November 2024.
Counsel for the parties and the surveyor shall meet within 10 days of the Property being marked/staked but no later than February 3, 2025, to discuss the Property as marked/staked and to decide how to proceed.
Plaintiff has three days from the meeting but no later than February 6, 2025 to decide if Plaintiff seeks a court order or seeks a variance/appeal.
If Plaintiff elects to seek a
variance/appeal, then counsel shall submit a consent order to the Court no later than February 10, 2025, and the case will be administratively closed pending resolution of the variance/appeal.
The Court reporter is to produce a transcript to Defendant by January 16, 2025. If not, then Plaintiff is to share a copy with Defendant and Defendant shall reimburse Plaintiff for half the cost.
