§ JOINT CONSENT MOTION TO AMEND THE SCHEDULING ORDER AND EXTEND DISCOVERY

COME NOW Defendant JOHNATHAN SWEATMAN and Plaintiff SARAH ZEEMAN (hereinafter the “Parties”), by and through their counsel of record in the above-styled action and move the Court for an Order extending the time the Parties have to complete discovery in this case. Accordingly, the Parties respectfully move this Court for an Order amending the scheduling order extending discovery and all other deadlines through September 12, 2023. STATEMENT OF FACTS

This case involves disputes over property line boundaries and stormwater runoff. Discovery in the case is currently set to expire on July 14, 2023. The parties have engaged in mediation and are currently still in ongoing negotiations. Per Ms. Zeeman, these further progress in these negotiations require a site inspection by the

parties’ experts to opine on bounds of the disputed property line and the source of the alleged stormwater runoff. The site inspection is currently scheduled for June 21, 2023.

Once this inspection is complete and the expert reports are finalized, if the case cannot be resolved, party depositions still need to occur, as well as the depositions of the experts. In

addition to these depositions, additional documents need to be exchanged between the Parties. In order to ensure the parties are in full compliance of the deadlines set by this Court, the Parties respectfully ask that this Court grant this discovery extension so that all depositions needed in this case may take place, all discovery information to explored and provided, and that

the site inspections may take place to provide a possible resolve to this case. This Motion is not made for the purposes of delay, but rather is made in a good faith effort by the Parties to prepare this case in the Parties’ best interests. The facts of this case are still developing, making this extension necessary for the Parties to present a complete case. The Parties states that no prejudice will come to any party and justice will be well served through an extension of the discovery period and time to potentially negotiate settlement in the case. WHEREFORE, for the reasons stated above, the Parties respectfully request the Court GRANT the Consent Motion to Extend Discovery. The Parties have attached for the Court’s

consideration and convenience a proposed Order extending discovery through September 12, 2023 and all other deadlines an additional sixty (60) days.
