JURY TRIAL NOTICE The above case is included in the two-week-long Trial Calendar before the Honorable LaTisha Dear Jackson beginning on Tuesday, May 28, 2024 at 9:00 a.m. in Courtroom 5B of the

DeKalb County Courthouse. Calendars are published on the Court’s website: www.dekalbsuperiorcourt.com/judges/latisha-dear-jackson/court-calendars/. The order of cases on the Calendar is not indicative of the order in which they will be tried. Counsel, parties, and witnesses, if any, shall be present and ready to proceed. Failure of a

party to appear will result in that party’s complaint or counter/cross-pleading being dismissed without prejudice, and any answer being stricken. Unless otherwise directed, only counsel and self-represented litigants need to attend the Calendar Call. Failure of counsel or a self-represented litigant to appear at the Calendar Call will

result in that party’s complaint or counter/cross-pleading being dismissed without prejudice, and any answer being stricken. Failure of counsel or a party to appear when called for trial will result in same.

If no deadline has been previously set, a Consolidated Pre-trial Order shall be delivered to

the Court via email to the Civil Case Manager, Ms. Renata Bili¢, rbilic2 @dekalbcountyga.gov, in Word format no later than 4:00 p.m. on Friday, May 10, 2024. e

Item 2 on the CPTO must estimate the time for trial and specify non-jury or jury and,

if jury, include a short summary to read to the jury. The paragraph designated as “Jury Issues” shall be completed as “Issues for the Fact Finder.” Any claim for attorney’s fees shall cite the contractual or statutory basis for the claim. e

The parties shall exercise best efforts to submit a consolidated pre-trial order. As set

forth in OCGA § 9-11-16, the parties are to confer “to consider (1) the simplification of the issues; (2) the necessity or desirability of amendments to the pleadings; (3) the possibility of obtaining admissions of fact and of documents which will avoid

unnecessary proof; (4) the limitation of the number of expert witnesses; and (5) such

other matters as may aid in the disposition of the action.” The consolidation process is also an opportunity for the parties to discuss possible settlement of some or all issues.

No party shall submit its own individual portions of the pre-trial order without a written

certification detailing the party’s good-faith efforts to present the Court with a fully consolidated order. Failure to submit the CPTO by the deadline will result in imposition of an appropriate sanction, including but not limited to removal of the action from the trial calendar, entry of a pre-trial order

as the Court deems appropriate, the action being administratively closed with no extension of discovery, or dismissal without prejudice. USCR 7.1. Parties shall alert the Court to any Motions in Limine by emailing courtesy copies. Motions in Limine shall be heard at a date to be determined prior to trial; no motions will be heard at trial. Three business day prior to trial, requests to charge and a proposed verdict form in Word format shall be emailed to the Civil Calendar Clerk. If the case involves the care, custody, or support of a minor child, the parties shall comply with the following prior to trial.

First, the parties shall attend the parenting seminar required by

the Second Standing Order Governing All Domestic Cases. Information for the seminar can be

found at www.dekalbsuperiorcourt.com/parenting-seminar.

Second, five (5) days prior to trial,

each party shall provide the Court with a proposed Parenting Plan required by OCGA § 19-9-1, a Domestic Relations Financial Affidavit required by USCR 24.2, and a Child Support Worksheet

required by OCGA § 19-6-15 and USCR 24.2. THERE WILL BE NO COURT REPORTER AVAILABLE. If you wish for the case

to be reported, you must retain your own court reporter. Trial will not be delayed or continued due to the failure to retain a court reporter.
