Hi Sarah,

Please provide copies of any correspondence that your private attorney has with Brett with respect to the transcript and the fees. I will review them as soon as they are provided.

The court transcript was not required for settlement. Brett, your private counsel, and Sweatman’s counsel had the terms of the agreement noted. I understand that you felt more comfortable reviewing the transcript to confirm the details of the agreement. It was my understanding that during the property visit, before we had the copy of the transcript, your private attorney confirmed the details of the agreement with you and Brett over the phone. Irrespective of this, a copy of the transcript was acquired.

Marimar,

You are incorrect.

He contacted Brett multiple times regarding this matter beforehand, during, and after. It is clear Brett did not do his job and notify you.

Similarly, Brett did not order the required court transcript, so I, the title insurance holder, had to inform Eric that you all have been mishandling this for months, as it was never ordered until I (the title insurance holder) brought it up to Eric. This transcript was necessary for the boundary line meeting with all parties and the surveyor (Brett did not have it) and to create the final settlement agreement.

As you are aware the deposition was a subpoena was filed by the opposing party. It was a requirement.

There was zero communication  by you or Brett on how the fees would be handled. As my representation,  you have a fiduciary responsibility to represent in all parts of this legal manner.

If you recall this is during the time of your suggestion for creative use of Brett’s escrow account to pay the opposing party 12,000.
