Memorandum Regarding (Non)Engagement of Attorney RE: Negotiating a boundary-line agreement with neighbor I / we acknowledge completing an initial consultation with Richard S. Alembik, PC (“Attorney”) regarding the above-described matter, and further acknowledge that [check all that apply]: No current engagement. I / we do not intend to hire or to consult further with Attorney at this time. Any future engagement by Attorney must be agreed to in writing. Future engagement. I / we intend to hire or to consider hiring Attorney for the purpose of representing as per a separate written agreement. ✔ Option to engage Attorney. I / we have the option of engaging Attorney for the sole purpose of performing the services described in the following Scope of Employment (the “Option”): Attorney will attempt to negotiate the terms of a boundary-line agreement with Jonathan Sweatman to address various issues involving encroachments and claims of prescriptive rights between adjoining neighbors.

and for no other purpose. If I / we exercise the Option I / we must first pay Attorney the following , which represents a “Prepaid Fee” to be earned. I acknowledge that Attorney sum: $ 1750 is not required to perform the Option until the Prepaid Fee has been paid in full. I am /we are not obligated to pay the prepaid fee if I / we elect not to exercise the Option. The Option will expire in 10 days from today's date ( 8/10/21 ) unless Attorney agrees otherwise in writing. Any payment by credit card or PayPal is subject to a 3% surcharge. ✔

Rates. The Prepaid Fee will be earned as follows:

Flat rate,

Hourly rates of $350/hour

(by attorney) and $125/hour (by paralegal), Not to exceed the Prepaid Fee (if checked). Prepaid expenses. That if I exercise the Option, I / We must pay the additional sum of ✔ $ 750 as follows: Estimate for updated survey (exact amt tbd) If Attorney agrees to perform any additional work, or to modify the Scope of Employment, such an undertaking must be set forth in writing and signed by all parties. This document sets forth the entire understanding of the undersigned with respect to the Scope of Employment (if any) and the above-described matter. Additional Terms or Information (Second Page of Memorandum Regarding (Non)Engagement of Attorney) Before taking payment, Attorney will attempt to confirm with Mr. Sweatman his willingness to pursue negotiations to reach a boundary-line agreement; if he is unwilling to do so then a separate scope of employment will need to be discussed. Survey costs are estimated and will need to be confirmed.
