Hey Linda its Sarah Zeeman how are you Good. How are you good how are you I'm well thank you have a nice weekend it was nice it was beautiful weather it's beautiful weather well I wanted to give you a quick call my lawyer for the countersuit was asking me if you guys have the building plans done yet or stamped or approved or however that works and well I mean you already had the stand building plans follow up plan where he was addressing the drainage yeah those were those were finalized last week I believe OK alright so those were finalized and so I put an FOA and I have not gotten that can I get those from you for the lawyer and yeah you have to go through the open records from I did yeah I can give you the ticket number I'll be able to find it just let me follow up and find out what's going on with that at this in the city clerks office yeah and they can get you a copy but I think I wanna say they were approved Monday or Tuesday of last week OK OK so I know they were so these are the final final ones that are approved by how does that work this is the last set of plans that he submitted to they were approved I'm not sure if the when I spoke with Mr Susan they were saying that they were gonna do the work on Thursday and be complete by Friday I don't know if that was done or not and I'm not sure if they called in their final inspection after they completed the work or not but that that was the last set of plans that we approved and so and so the next step murray does yeah if he hasn't done it already then yes it's OK final fight OK because the reason I ask that is those those cement steps are still in the sewer easement of the deck and you can see that from the road so that's why I was curious and so yeah we weren't they were allowed to stay we and as well in the cab did not care 'cause they're movable if they have to come in they'll just lift them up and get my way really that's interesting yeah I mean there's not they're not really a the pipes are kind of a different thing because those are dug in there those are and they can just leave those they did get permission from the cab to leave those pipes as well really that's very interesting they were going to that's interesting OK well I'll let my lawyer know about all this stuff so in that way he can we can do that so we look forward to getting that plan if you can help move that along yeah I will I will follow up with cool thank you OK bye bye you're welcome bye

1/27/22 Phone Call Getting Linda to come to property 33:18

committed stamp drawings from a surveyor so there as built as far as that goes then the additional grading and stormwater that was will we run into an issue that we are continually working with the neighbor to correct he should not have typed anything and that's where the decab county easement comes into play so just to kind of give you a background of how our permitting process works when easements are involved so the cap county isn't really involved unless there's an easement on the property and we spend every permit to them to give us a you know to make sure there's an easement there to make sure that we are steering clear of the easement and the original permit that was sent for the death was sent and was sent back to us saying that it was OK it was not encroaching in the easement when he went and did the additional work on the landscaping and the drainage at that point it was noticed that he was encroaching into that easement so we did send it back to the cab county knowing their answer because we they typically don't want we don't want anything in our easements and they don't want anything in there but they said no it can't go in the easement which we had advised him of I know he's continually working through that process of getting you know to meet coke so they can't have any easement situation there was no requirement for like I said the company doesn't if there isn't even there or there's you know either a sewer line or a water line that the cab county needs to be aware of we obviously adjust the plans off of that but we have made that correction and we have notified him that he cannot put it there and so he is modifying his plans to do that and I think he just recently submitted within the last day or so revised plans which I believe now his intent is to just put everything back to the way it was so he's going to remove the piping and just drain the property or rain the property back to the way it was so it is legal it looks like your property is downhill from his so water is going to flow it should not flow in a concentrated manner it needs to flow to sheet flowing manner so there shouldn't be like one pipe that's just dumping out on your property of so yeah I mean all the photos I've seen he he did make a mistake in an error by you know doing more land disturbance work that he was approved for and we are you know going through the steps to take that corrective measure on his property for that as I mentioned in my email I you know I'm looking at a photo right now kind of where it has washed out your property where the water has come through any property damage there unfortunately the city you know you're welcome to the documents as you know for the open records request process but we don't get into disputes between property owners as far as that goes so anything any damage to your property because of that would have to be end of civilly between you and him and you know through the open records request process you're welcome to any of that documentation to help your case as far as the fence goes I was the one who made the determination that the fence was met our code and it's not necessarily yes it's finished side out but if the size match we consider that finished because it's the same on both sides of the fence and the way his the fences design we have a lot of fences out in the community that are designed like that now that's how they were installed that's how they're put out so due to the fact that it matches on both sides of the fence we consider that you know the completed fence but finish that out as far as the nails go as we've asked him to address the nail situation I will continue looking through the code but I don't have anything in the code that will allow like I can't go through a ticketing process to get him because there's nothing there's not a code section that gives me any kind of peace on that but you know we we will do our best to kind of hold him to try and take get over there but I think at that point you'd have to grant him access to your property to get over there to do that I'm not sure if you know you're willing to do that or not but that would be again between you and Sam we can't force you to do that and I can't require him to track pass on your property and yeah I don't know what else I know there was a tree issue at some point and I think we had a miscommunication on our part Orlando did contact the tree canopy manager and the two of them had a discussion and the case was closed but I don't think there was there should have been communicated to you that the tree canopy manager you know what he had already made the determination that setting the river stones on the base of the tree was not impacting the tree and so he cleared it with Orlando and I guess that communication didn't get over to you or if you were expecting to speak to him that communication didn't happen but I know the tree canopy manager did look at the area of what was going on out there and determined at that time that there was no impact to the tree he's also part of the review for the drainage and this new permit so anything that does get approved will all have been looked at by him to make sure there's no impact to the trees I don't know I after saying that I don't know if there's anything else that that you have I don't know what you know I do and thank you for things that we can do yes yes thank you and I appreciate you stating all those things a couple things the for him to revert the underground storm system the stormwater drains to how they were previously I have the photos they were buried underground illegally previously so I hope that's not going to be the case because he has been flooding and now that there's more impervious space it is unusable for when I sent the videos of the flooding and the water that every time it rains everything from his roof comes into my yard the second question I have there are three properties two are done correctly and one is not why is it OK that two can be done correctly and one is not and then my third thing was that re questions went 100 days and meet with four reminder emails completely ignored asking a question just asking a question which code it was and I never got an answer and then my fifth thing was I don't appreciate Orlando forwarding my emails to his wife mocking me and then me finding out via foa that that and that he did that that's not I'm a I'm a resident why am I being mocked to his family members via Brookhaven emails and that that situation was addressed with Orlando that that was not appropriate to do and we have addressed that situation with them regarding that question I apologize I was trying to write down your questions and in order the first one with stormwater I'm sorry what was the second sentence was the second the second one and I if you could just come look at this you'll it'll make more sense than photos I promise if you could just come look I know you're so busy I don't know if there's any 15 minutes that you could just squeeze in to look at it ends up being a lot more than 50 minutes and I I don't think you're gonna get a I I am happy to try to figure out a time that I can come out and take a look at it but I don't I I just want to let you know now I don't think there's going I've seen enough documentation and I I can
