Good morning Ms. Zeeman:

It has come to my attention that you have been having issues with a construction project that was done by your neighbor. The following is my understanding of where the City is with correcting the situation. Please let me know if I am missing anything.


  *   A City inspector was doing an inspection on the property when it was notice the property owner was doing additional work outside of the scope of the original permit. At that time the property was placed under a stop work notice and the applicant was required to revise the plans to include the additional work. The applicant has been working through the permitting process to meet the minimum requirements of the ordinance. The applicant has recently submitted new plans to restore the yard back to the original grade. These plans are still in the review phase and have not been approved by the City at this time.
  *   The fence was installed correctly and is not in violation. We have asked the property owner to address the nails protruding on your side of the fence. There is not a code section I have come across to enforce the nails. We will continue request the property owner address this situation.
  *   The trees have been reviewed by the Tree Canopy Manager and no violation was found.
  *   Any property damage that may have occurred to your property would have to be handle as a civil matter between you and the neighbor. Hi Murray,

As we discussed on Friday in front of a guest at my home, first how 2746 was built beyond the scope of the permit and COB is aware of this, but we also addressed how Code enforcement did not apply code Sec. 27-955 equally and fairly to the 3 abutting properties.

Could you please explain why 1 property fence side (2740) does not follow the code for the finished side and the other two properties correctly follow the code Sec. 27-955?


As for nails: Code enforcement was sent pictures of the 2740 unfinished fence & nails via code ticket  ID# 2395207
