Let me see. Last I heard is one of the property owners is trying to bring the City into more then just getting the judge to waive the variance process. The City was just trying to be helpful by asking the judge to be the variance deciding factor not the board of appeals. My recommendation to the City Attorney was to just decline our offer to assist and both property owners will need to submit a variance for the non-conformities.
