The City does not return landscaping with like landscaping within the City rights-of-way (ROW). To the extent
that the bushes and trees in the before picture were in the ROW, the City will not replace. If you have the name of the City employee that stated the City would replace trees and bushes, please let me know. | am copying the Public
Works Department to discern if the tree and three bushes in question were in the ROW. (pictures attached). If not, the City will replace.
2.
The City will appropriately prepare and sod the grass area in the second photo attached. Once that has
occurred, you will be responsible for maintenance (i.e., mowing)? Do you accept this responsibility?
If this approach works for you, please advise and | will have the work scheduled.

Hi Christian,
We had spoken briefly at the end of the city council meeting on 8/16/18 in regards to the Osborne Storm Drain Project; you mentioned you’d like me to email you more details and my address. Thank you so much for offering assistance as this has been a very long and difficult 430+ days since the start of COB's project. Things went awry since the project was officially completed. Unfortunately, we are still dealing with some unfinished business on the Storm Drainage Project, pertaining to my property at 2740 Grove Street Brookhaven, Georgia 30319.
There were many oversights on behalf of the contractor in charge, but the most pertinent details and how they impacted the property are summarized here:
(1) BLOUNT construction never sifted the asphalt out of any of the soil and proceeded to hide it under hay after they had chopped up the vegetation and landscaping
(2) The asphalt/debris is embedded deep into the yard, and new vegetation cannot grow under these circumstances, we’ve made every attempt to try, at our own expense. We have have been requesting for the 2
city to dig it out and safely and adequately remove/dispose of it. It’s an eyesore and a point of friction between the neighbors that’s beyond our control.
(3) Attached are the before and after pictures of the yard/tree/bushes that were chopped up. And as we’ve
been asked by the city to submit our request, it remains the same. We would like the area to be landscaped back to an equivalent that represents Brookhaven’s standard of excellence we’ve come to expect with our community. We took great pride in our corner, and we treated it as so since | purchased the property in 2006.
On the day BLOUNT chopped up the yard, we were told by the city staff at a site that they would replace the Crape myrtle and three bushes BLOUNT removed. We originally agreed with BLOUNT to salvage the original landscaping, we were to care for it by watering while the dirt was removed, and they were to place it back after work was completed. BLOUNT never honored our agreement; they instead chose to destroy it out of convenience. We then contacted Shane Cape, and he came to the property and met with us about the vegetation/landscaping issues. The city also sent arborist; Steve Strickland to meet at my house in October of
- Steve met with us and said he would speak to his vendor for the replacement or equivalents, provide some options that would suit the conditions of the land and they never came back as we were told in person
by Steve in my front yard.
We were provided (ticket #) Work Order 4038 to resolve the issues and as shown in the pictures the asphalt/ debris remains in the yard on two sides of the property on Osborne and Grove street. This still has yet to be resolved.
We appreciate you stepping in and fixing this, and we welcome time at your convenience to discuss how/when everything can be corrected, including landscaping after the debris/asphalt is dug up and removed
from the right of way.

There looks to be a miscommunication. There are a few city workmen out in the yard laying dirt and hay directly on top of Blount’s construction rubble. Unfortunately they are not removing the Construction debris and asphalt dumped in the front by Blount, such as this rusted pipe still embedded in the yard for over 400 days. The construction debris is engrained in the yard and now has hay over it again.

attached. Is the city is digging up the asphalt and construction rubble deeply ingrained in the yard on
both the Osborne side and the Grove Street front area created by Blount? 5
We would like to clarify that the responsibility we inherit post COB’s remediation effort is what should
originally have been expected upon completion. And that the site is to be left in such a way that will allow natural growth of vegetation without undue expense to us (such as sprinkler system installation,
irrigation work or further dirt/topsoil installation). Without a thorough cleaning of the areas effected by Blount, COB’s and our time and money will both be wasted. We just wish to note these concerns ahead
of time. As mentioned "We took great pride in our corner, and we treated it as so since | purchased the property in 2006", but unfortunately, our landscape company has been handicapped by the asphalt debris and conditions left behind by COB. With my experience in the real estate industry, | understand the
responsibility that a ROW delivers, and we intend to resume maintenance of the land as our own after remediation has been completed. Thank you again for dedicating time to fix this situa
