Good morning Ms. Lewis, By way of an update...our contractor, Matt Johnson, is in the process of re-drawing the deck, with a revised foot print that will meet the easement/setback requirements. We expect that revised drawing soon. As soon as we do get that we'll forward to you for your review/comments/approval. Assuming the new plan meets with County code and your approval, is it reasonable to assume that is the last step and so we can then proceed to get our permits from both your office and City of Brookhaven, and then proceed with the work? Good afternoon, You are allowed to move the posts and deck so that the portion of the deck the deck that is encroaching is not in the easement . A cantilever deck into the easement is also not allowed. The easement is 10' off center of pipe on both sides for a total width of 20' . There are no variances or appeals to this DWM Code on this requirement. Thank you,

Good afternoon, and thank you for your response. We have been thinking about a possible solution to this issue. Perhaps you would be so kind as to consider the following. The bottom of the actual deck structure on that corner where the easement passes below is 9 feet 6 inches above the ground If we were to set back the corner post (or indeed all the posts) closer to the house and cantilever the deck structure to it's current line, would this be acceptable? For our clarification, what is the current code regarding the width of the easement, either side of the center line of the sewer line itself? Also, if the corner post were set back OUTSIDE the easement and it were just the deck that OVERHUNG the easement, would this be acceptable? Lastly, do you offer any sort or review or appeal process? I do understand the need for the county to have access, in the event you needed to get to and work on the sewer line, however, setting back the corner post by 2 feet or so and allowing the deck, 9 feet 6 inches above, to overhang would still allow plenty of access. My wife and I have been working on this project/issue for over nine months now and we have invested considerable time and money into our research etc.

Mr. Sweatman, I have reviewed your attachment from your surveyor and it clearly shows that your deck is in the sanitary sewer easement. Based on your email below the sewer line is not under your deck however your site shows that the easement associated with the sewer line is encroached by your deck and that is not allowed. You have sent your email to Mr. Jeffery Woods also copied on this email who Matt Johnson was working with before to update the GIS map if it is indeed incorrect. I cannot approve your site plan until there is no encroachment in the easement. To whom it may concern, My wife and I own our house at 2746 Grove Street, NE, Brookhaven, 30319. We have been working on some renovations and upgrades recently, using a contractor called Artisans of Atlanta, run by Mr. Matt Johnson, copied here. We have applied for, and been granted by the City of Brookhaven, permission to upgrade our back deck to a screened-in porch, however, Brookhaven has then passed the application on to DeKalb County for one more step. The issue is this: There is a sewer line that runs through our back yard. On the current county maps/plans, it shows the sewer line running directly under our deck, with no easement. Clearly this would create an issue for upgrading the footings and supports for the new porch. However, a simple look at the man-hole covers in the surrounding yards indicates that not only does the sewer NOT run under our deck, but that the current county drawing is inaccurate. Recognizing that my “untrained eye” may or may not be able to determine the exact route/location of the sewer line we engaged a specialty utility location service, who used a metal snake with a tracking head and ground penetrating radar to determine exactly where the line runs. We then engaged a surveyor to re-draw the actual location…and they have all determined that the line does NOT actually run under our deck. Please see enclosed the current county plan and the results of our surveys. Mr. Johnson has been in contact with various members of your team at the county, but has yet to be able to find the right office/person to review these drawings and make the determination that us upgrading the deck would NOT impact the sewer line…and hence grant us permission to proceed. Matts most recent communication was at the end of last month with Mr. Jeffery Woods whom I have also copied here in case he suggests forwarding this to a different department. Matt has also been talking to Yola Lewis in the county offices. We are keen to achieve the following: Find the correct department and team members to help us review the issue Have the county make a determination as to the exact location of the sewer line and correct the county plans Take that info back to City of Brookhaven Have the permit issued Proceed with the project Since this research/permitting process has been in the works for over six months now, we are very keen to find the right people to help us...get the issue resolved and complete the project.

I am available to review and discuss any further info you need...we can easily grant you access to review the property and share any/all of the data, drawings, plans etc., that we have assembled. Thank you in advance. Jonathan Sweatman

Very good. I am out of town but will Work with my wife to get those to you tonight. To be clear, we’re talking about the survey we had done, showing the sewer line and hence the easement, and therefore the deck location relative to that? Correct?
