Hi Sarah,

It is customary for a surveyor to speak to all of the parties when surveying properties. There have been plenty of instances where a surveyor will even speak to neighbors when only one property is being surveyed. This situation is no exception as the survey is for your property and Sweatman’s property. The surveyor will need to speak to all parties in order to complete the survey.
With that said, I am not aware of any conversations that Sweatman or his counsel are having with Gaddy that would be inappropriate. Is there a particular conversation that Sweatman or his counsel has had with Gaddy that you find to be inappropriate?

Please help me understand why is Sweatman speaking directly with the Surveyor?

The surveyor knows to go through Brett who is paying him if he has questions or concerns.

Sweatman’s questions need go through Brett and not Sweatman calling the surveyor directly.

I paid for the insurance, and my insurance paid for the surveyor.

We are not waiting on Sweatman’s counsel to provide measurements; we are waiting on them to determine how they are going to proceed with the impervious surface issue. Due to the new measurements of the lots, Sweatman will have to either go through City Council for a variance with respect to the impervious surfaces or acquire a court order. The court order would be more efficient process, but the decision is ultimately Sweatman and their counsel.
Please note the Gaddy is surveying both properties and will need to communicate with all of the parties in order to bring a resolution to this claim.
