                Thanks for the response.  I read your email to mean coverage would be pulled as soon as a survey was created showing no encroachment.  Are you instead saying that the new survey could lead to evidence that results in the court’s dismissal of the plaintiff’s encroachment claim and that the defense obligations of Stewart will end if that is achieved?

I will provide any letters once the new survey comes back.  I would expect that you would be advising Ms. Zeeman on the counterclaim as Ms. Monico was only retained to represent Ms. Zeeman with regard to any encroachments and that was the point of my email to Ms. Zeeman.

                I am counsel to Ms. Zeeman with respect to the counterclaim and have been forwarded a copy of your email below discussing coverage.  Please provide any reservation of rights letter issued and explain the basis for your statement that “if the new survey shows no encroachment then there is nothing left for retained counsel to defend.”  If you are relying on a term in the applicable policy, please provide that as well.
