The surveyor was scheduled in October, miramar/Brett never signed the agreement, so the surveyor took another job.

I am sorry you are unhappy that this claim is still open. Unfortunately litigations take time to resolve and while I sympathize with your frustration I do not believe this is an inordinate or unusual amount of time.
You will recall that from the first day you contacted me, I made sure we retained the surveyor you requested, Gaddy. If Gaddy himself is stating below that he just drew the survey last week and was still working on completing it, then the file would necessarily remain open as that is something that needs to be completed in order to resolve this matter. The payment is a non-issue. You are not responsible to pay and it will be paid and taken care of. I am advised that this has already been addressed.
Regarding the transcript, as I have told you, I directed Brett to obtain a copy several weeks ago. Your neighbor’s attorney has thus far refused to provide a copy, despite our willingness to contribute to the cost of the transcript. There is apparently a several month delay in obtaining it directly from the Court reporter. There is nothing that I can do to change the timing. I have authorized Brett to pay to obtain it from either the court reporter or opposing counsel. If you have some other idea, please let me know.
