Brett has ignored the court order to move the fence ( page 14 of the transcript).
When everyone went to define the boundary line, Brett arrived late with no court transcript. The 4th survey was provided in February 2025. Out of nowhere, in March, I received a fire drill email while I was traveling and in transit, stating they had added a cantilever 9 months later, after 4 trips to the properties and changed the survey date. When I got home, I emailed Brett and told him I did not understand what was going on.
Little did I know Brett - had already closed and signed off on my case, losing my protection of the court. - This is not a standard protocol.
Brett and Marimar have said absolutely nothing about closing my court case, as the policy holder, I only learned this occurred by personally going onto dekalb county's online portal,

My lawyer reached out to Brett again and he was on vacation.
Meanwhile it was clearly defined at court when the fence was to be moved a year ago and it has not moved.
Brett filed and closed the case without properly following the court’s instructions and Brett never notified me he closed the case.
Fence has not moved - his house can be sold today and I am not protected.

The Court closed the case as it was settling rather than going to trial. The settlement agreement contains provisions for the removal of the fence and the time for your neighbor to do so would be from the receipt of the Final Reconfiguration Plat or and/or the full execution of the settlement agreement.
This is all the more reason for you or your personal attorney to get back to Brett concerning the settlement agreement and get it into final form to be fully executed.
