The Court closed the case as it was settling rather than going to trial.  The settlement agreement contains provisions for the removal of the fence and the time for your neighbor to do so would be from the receipt of the Final Reconfiguration Plat or and/or the full execution of the settlement agreement.

This is all the more reason for you or your personal attorney to get back to Brett concerning the settlement agreement and get it into final form to be fully executed.

Brett closed my court case back in March.

I have no protection by the court now for the opposing party to follow the court record from trial. I have performed my part.

The neighbor has not moved the fence and it’s been over a year. He can sell his house today and never move the fence.

The neighbor’s fence still has not been moved, and is still violating the court order called into the court record for him to move it for over a year.

His fence has been trespassing on my property for 5 years now.
