TPA Project No. 1-16-0385 Dear Ms. Cole: Per your recent request, Travis Pruitt & Associates, Inc. (TPA) has prepared this brief
report describing for the above referenced project site. The project site is located in City of Brookhaven in Fulton County, Georgia off of Osborne Road NE. The site is bounded by north, east and west by private land owners; and by Devine Circle NE/Osborne Road NE to the south.
Based on information provided by you, the site totals approximately
11.5 acres.
The purpose of our study was to identify any areas that would be considered jurisdictional by the U.S. Army Corps of Engineers (USACE), identify any areas that are
State Waters, identify potential protected species/habitat and and floodplains that mybe found within the project site. On August 3, 2016, Brandon Lane of TPA conducted a waters/wetlands delineation on the Osborne Park Site. USACE Jurisdictional waters and wetlands, will be identified using the Routine Onsite Determination Method as found in the 1987 U. S. Army Corps
of Engineers (USACE) Wetland Delineation Manual and The Regional Supplement to the USACE Wetland Delineation Manual: Eastern Mountains and Piedmont, Version 2.0. Wetland Boundaries were flagged with orange wetland flagging tape.
In addition to
USACE jurisdictional areas, State waters also were identified and flagged using blue flagging tape. The areas flagged are depicted on the attached approximate wetlands map Figure # and should be survey located during any future survey efforts.
Based on the jurisdictional delineation, waters/wetlands were limited to unnamed tributary to Nancy Creek and an isolated wetland located within the floodplain. Any

proposed impacts to Nancy Creek and/or the isolated wetland feature would require
permitting through Section 404 of the Clean Water Act. However, based on the approximate location of the northern property line, the Unnamed Tributary to Nancy Creek appears to be located offsite no the adjacent property north portion of the site. In addition to the Unnamed Tributary to Nancy Creek being considered jurisdictional by the USACE, it also will be considered State Waters by the City of Brookhaven and the GAEPD. Therefore, the Unnamed Tributary to Nancy Creek will require a 25-foot
undisturbed State Waters buffer; and a City of Brookhaven 50-foot undisturbed stream
buffer and an additional 25-foot impervious setback, outside the required City undisturbed buffer. In addition to the waters and wetland identification, TPA also conducted a protrcted species survey on the Osborne Park property.
In order to determine if protected species
and/or their preferred habitat is found on the site, TPA reviewed the US Fish & Wildlife Service “Information Planning and Conservation system (IPaC)” and Georgia Department of Natural Resources, Wildlife Resources Division, Natural Heritage Program (NHP)
database, via the Internet. On August 4, 2016, TPA reviewed the iPac database. Based on the IPaC search, there . were no critical habitats listed in this location. However, there were migratory species
listed that could possibly be affected by activities on this location. The IPaC printout has been included for your review, attached. In addition to the IPaC search, TPA at the same time conducted an in-house literature and records review of existing information to identify potential protected plant and animal
species likely to occur in and around the project site. TPA conducted a literature review of the Georgia Department of Natural Resources, Wildlife Resources Division, Natural Heritage Program (NHP) database. TPA confined this search to the Chamblee SW quarter quadrangle map and the eight surrounding quarter quadrangle maps
(Sandy
Springs NE & SE, Chamblee SE, NE & NW; Northeast Atlanta NW & SW; Northwest
Atlanta NE). The database was examined to determine previously identified protected species potentially occurring on the nine quarter-quadrangle maps. According to the
literature review of the NHP’s database for the nine quarter-quadrangle maps, one species are afforded federal protection, and five species are afforded state protection
(Table 1, attached). Following completion of the iPac and NHP literature review, TPA personnel conducted a protected species survey of the project site. The purpose of the survey was to identify
the absence or presence of protected species and/or their preferred habitat on the project site. During the protected species survey, TPA personnel did not observe any
individuals of the identified species. Special attention was paid to areas of potential habitat, however, no sign of preferred habitat was found. Therefore, any activities on the site should not adversely affect any protected species. Finally, in order to determine if any of the site was located within a 100-year floodplain as mapped by the Federal Emergency Management Agnecy (FEMA). TPA reviewed the FEMA Floodplain map using Floodplain Map Service Center.
Based on the FEMA map
for the project site, (Map Number 13089C0013J dated March 5, 2013), a portion of the

western and northern part of the site is located in a Zone-A 100-year flood plain. Zone-A 100-year floodplains are floodplains that are studied with base flood elevations. The base flood elevation adjacent to the site ranges from approximately 847.7 to 855 MSL In summary, the areas that would be considered jurisdictional by the USACE are limited to the unnamed tributary to Nancy Creek located on the north side of the site, just off property and the isolated wetland located in the northwest corner. The limits of State Waters are limited to the unnamed tributary to Nancy Creek located just north of the site. In proposed impacts to the isolated wetland will require permitting throiugh the USACE’s Nationwide permitting process. Nationwide Permits limit the amount of stream impacts to less than 300 linear feet and/or 0.50 acres of jurisdictional areas, e.g. wetlands. Mitigation is required to offset the impacts that exceed 100 linear feet of stream impacts and/or 0.10 acre of wetland impacts. Per the conditions of the NWP and the Savannah District’s regional conditions, it is necessary to submit a Pre-Construction Notification
(PCN) for all impacts associated with this type of activity. Therefore, it will be necessary to submit a PCN for any proposed impacts to the isolated wetland feature and/or the
offsite unnamed tributary. Any Disturbance, with the exception of a road crossings or utility line crossings, within the 50-foot City of Brookhaven undisturbed stream buffer will require the issuance of a variance from the City. Limited grading is allowed in the City’s 25-foot impervious setback without the issuance of a variance. However, no impervious areas are permitted in this area without the issuance of a variance. Additionally, disturbance within the 25-foot State stream buffer, again with the exception of a road crossings or utility line crossings, also will require the issuance of an additional variance form the GAEPD.
