They emailed him with me on copy and, as aforementioned, the survey is a re-plat of both properties. It didn’t impact the property lines or cost any additional sum of money; it was a non-issue and necessary to get the plat before the Court as demanded by the Judge. As for the final plat, I sent it to you already and it was attached to the order entered by the Judge. I want to highlight that the new boundary lines are set; we still need the City and County to approve and record, but the title concerns are resolved by the new plat. Per the settlement, the fence needs to be moved in the next 30 days which means we need a settlement signed or we aren’t going to be able to enforce it. They could, hypothetically, go to the court and ask that the deadline to move the fence be extended if we delay finalizing the settlement further.

I absolutely need you to review the settlement agreement redlines I sent over. We do not want to risk opposing counsel going to the Court and asking for sanctions; this Judge has been on top of us to get this done and the case is administratively stayed, not closed out.

Please answer my 3 questions:

Why are they calling the surveyor when you hired him, and my policy paid for it? Did you tell them to call him?

On that note, please send me the topographical report with the new alteration they called in. My policy paid for it. Can I please have it?

The plat is attached. The Plat is for both lots and the accuracy of the lots has nothing to do with who paid for it. We want it accurate to avoid future issues.

I did not ignore your emails. With regard to title, I have responded. The other claims need to be addressed by Jeff. Opposing counsel asked them to add it and Gaddy did. It’s accurate – that is the shape of the house. It does not impact anything in our case.

Please review the settlement agreement so we can get this finalized.
