Sarah,
I would strongly advise against asking the Judge. The deadlines, per the Order, are all within the next week. The Judge explicitly gives them time to go the variance route if they choose and if we ask for money before execution, I do not see the Judge granting that without sufficient cause. We would need to show it’s necessary to effectuate the settlement.

Let’s request it to the Judge/court.
They are the ones holding it up.
The ball has been in their court for months to decide which way to do the settlement agreement .
His lawyer lied to the judge about the Stakes not being performed as an attempt to take advantage of my insurance resources for a frivolous unnecessary surveyor re-visit to re-stake.
They have the impervious issue & was a non-conforming lot before he started the lawsuit
Plus- they’re holding my settlement check hostage.
Can you also ask the judge that he remove the strings, They are unnecessary for 4+ years and now we have stakes. Or should i go add my own string too… 😎

The request was objected to and I also just went through the transcript. In the transcript, the Judge says that the funds are released once the settlement is signed “within a reasonable amount of time”. If they don’t consent, we would need to ask the Judge.
