David and Tania,
Sarah is interested in mediation but not with Phill Bettis. Please let me know your preference for an alternative. I like George Ried but think we should propose 2-3 names to plaintiff. In talking to Sarah, the plan is to set a mediation for about 90 days out so we have time to get initial discovery responses out and back from plaintiff and so Sarah can get together an estimate to repair the damage to her property.
Can one of your offices put together initial discovery requests to plaintiff, and we will add what we need for the counterclaim? We should try to serve that next week.

Lucy Aquino is no longer with Swift Currie. Joe Emanuel, who is copied, will handle the defense of the claims asserted against you by Mr. Sweatman. Please send any future e-mails that you would have sent to Lucy to Joe.
I am not sure what Lucy discussed with Lisa Rose, but perhaps Tania Tuttle can advise. I also understand you have also sent a number of e-mails regarding Mr. Sweatman painting the fence yesterday. I suggest you discuss these concerns with Rich Capriola or his colleague Eric Coleman. As I trust Lucy discussed with you, our representation is limited to the defense of the lawsuit.
