| am OK with the decision of using Allied Fencing and I’ve received their business license for the application.

Per the city of Brookhaven bi-laws, a permit is not required for replacement of an existing fence but it is noted that they need to be notified via the application form of the replacement and to ensure if the contractor is licensed and insured.

| do appreciate your idea of the cement wall concept under the fence and am open to considering it and looking into it further. | do believe we will have to confirm with city on what permits or requirements would be legally required for the proposed concept. Best,

Yes, we do still plan to use Allied Fence, however, with all the rain the whole project is a week or two behind. I'd bet we'll be in March before we're done with siding, paint, landscaping etc., and hence ready for fencing. On a related topic...as you look along the fence between our yards there is a drop of about six inches from our side to the fence, and another similar drop on your side. We are planning to simply grass over the whole of our yard, which we hope will reduce run-off in the future, but clearly all the water and silt have contributed to the root on the bottom 6 to 12 inches of fence. Should we consider a very low wall....just enough to sit the fence on and keep the silt from running down to your yard? It would be super-simple...just high enough, no big design...just to act as a "footer" for the new fence? Lastly, do you think we need a permit to "repair/replace" the existing "grandfathered fence? | Know Brookhaven has design rules, but that is only for fences facing the street, which you back fence and our shared fence do not. | just want to be sure we're not opening a can of worms with the city. Your thoughts?

If so, as we previously discussed I'll be paying him directly for my yard and 1/2 of the line we share. The next step would be to submit the application to COB for approval. When | get home tonight I’ll fill out the application for the 2 properties etc and send it to you to review and sign your part of it to submit.

The city’s process is on an application basis and the application is available on the city website. The city and zoning committee will the. review the application (4-5 business days) and then they will come back with an approval, conditional approval or denial. The application requires the contractors insurance and business license numbers etc.

Since this area is the ROW on a main road, | don’t believe it is restricted to 4 feet and can go up to 6 feet. | do believe the 4 feet limit is in regards to the front of the home but that side is a gate, so should be able to be OK? 2. Additionally the “re-zoning” situation on Kendrick, | plan on fighting it as | already suffer the blunt of it from excess flooding every-time it rains as the current storm water solution in place is inadequate and will only get worse. The “top rail’ decorative piece and the “decorative” vertical every 8 feet were not a big deal.

His concern was the 4 feet limit on fences facing the street

| think for your fence that faces both Grove and Osborne, there'll need to be some clever use of “Repair/Replace” and “Grandfathering of existing fence”.

Her suggested a trip to City Hall...so perhaps that can happen in the near future... what are your thoughts about 4 feet?
