                I spoke with Maureen this morning and expressed your concerns.  She informed me that they learned of Rose’s involvement a few weeks ago when she asked Frank if he could get involved on behalf of Sweatman.  He declined and told Rose he was already working for me on your behalf.  Maureen was very clear that they will not share any information about your case with Rose.  Maureen offered to speak with you directly and asked you to call her office to set up a time.

                At the conclusion of the call, I asked her to have Frank complete his report as soon as possible and that I would let her know if you still had concerns.

                Please let me know if this resolves your concerns or if you want to terminate HDA and retain a new expert.  Call if you want to discuss.

I have let Haight Davis know to stop work on your case.  We need to get an alternative engineer onboard asap if we are to get this case to mediation.  The following are two engineers that you may find acceptable.  Please call them or and anyone else you want to consider.  Once you have selected a new engineer, I will retain that person on your behalf to protect the work product privilege.
