I told them to use the original one but to stay out of the properly line dispute.  Why do you ask?

I don’t see that Rose can assert a conflict by our using HDA since they have done no work for Sweatman.  The fact that HDA has worked for other clients of Rose is not a conflict.

  1.  Was Maureen/Frank instructed to use the original survey from the lawsuit or the new one (weaker for me) from the title company?
  2.  Are there potential Rose law-created “conflicts” that would cause me issues if this goes to trial?

                I spoke with Maureen this morning and expressed your concerns.  She informed me that they learned of Rose’s involvement a few weeks ago when she asked Frank if he could get involved on behalf of Sweatman.  He declined and told Rose he was already working for me on your behalf.  Maureen was very clear that they will not share any information about your case with Rose.  Maureen offered to speak with you directly and asked you to call her office to set up a time.

                At the conclusion of the call, I asked her to have Frank complete his report as soon as possible and that I would let her know if you still had concerns.

                Please let me know if this resolves your concerns or if you want to terminate HDA and retain a new expert.  Call if you want to discuss.
