If you are putting your medical history at issue as part of your counterclaim, they are entitled to the records that support your claim. Mr. Sweatman has not made any such claims in his petition and we have no basis to request his medical history.

I am copying Richard to this email as he may want to discuss this further with you. Your medical history is not relevant to the defense of this action, but it may become relevant to your counterclaims.

Do I have any medical privacy rights with this suit?

Does this mean 10 years of my medical history will be accessible to anyone “the other party” would like to distribute it to or speak to about it?

If this is the case, can we request 10 years of theirs?
