Thanks for the update. As part of the Citys approval process, will all interested parties need to sign in wet ink the first page of the Plat that was attached and incorporated into the Courts Order?  For reference, I am referring to page 4 of the attached Court Order.

It can also be an amended order with the City acknowledging and accepting the Order/plat reconfiguration without a variance process if thats an option where you wont need to become a party.

Good morning.  Sorry for the delay responding to this issue as a follow up to our recent call.



The City is willing to 1) make a limited appearance into the case as a nominal defendant for the limited purpose of the court having jurisdiction over the City; and 2) amend the prior consent order whereby the City will agree to waive the variance process for the re-platting and replat the boundary lines without requiring the homeowners to go through the variance process.  At this point in the process, the County does not need to be involved, but ultimately the County will need to approve the re-platting.  The City will not be involved in any other pending aspect of this litigation or any other concern, issue, or dispute between the parties (such as alleged code violations).  For purposes of this discussion, the City is solely focused on the variance process for the non-conformity due to the boundary line change and re-platting.
