Email Body
Sarah,

I hope all is well. I just wanted to let you know that we followed up with the Court reporter again on Friday regarding the transcript we haven’t received. Tomorrow’s hearing is via Zoom and you do not need to attend; it’s merely a status conference. That being said, opposing counsel’s refusal to give us the transcript and, more importantly, refusal to tell us if they are trying to proceed with a variance appeal over a Court Order for the impervious surface issue will absolutely be brought to the Judge’s attention; I am sick of their games and delays and this hearing marks the perfect opportunity to ensure that there aren’t any more games moving forward. I will also make sure to have a proposed order regarding the impervious surface issue and I am willing to bet that we will have an executed Order on that by the end of the week. Technically, it’s not our place to make Sweatman decide between seeking a variance/appeal and the Court Order route, which is why we didn’t email the Court with the unilateral suggestion. That being said, I assure you that I will be making said unilateral suggestion tomorrow.

We can set up a call after the hearing. Please let me know your schedule and which number to call you on, if you’d like a call, between 11AM and 1PM.

If you have any other questions or concerns, please let me know.

Subject: Why are there 2 hearings in two weeks?

Hi Brett,

Miramar’s telling me there is an additional hearing the day after the 1st one, on the 14th?

 Why?

Also since sweatman has the final survey and the transcript, can I please have the copies too?

Thank you!
