I’m not sure I can ask the elderly couple behind both homes. He’s lived there prior to both of us.

I also still have the original marketing packet, from 2006 would that help? I can look through my 2006 closing documents/appraisal if that would help?

Hmmm… I am beginning to think that the original April 1, 1994 survey did not actually showed the fence. It looks like that was added by hand and not done by that surveyor. I could be wrong. Is there a way to clarify or resolve that issue?

The 1994 survey of 2740 was included in the seller's marketing /closing packet when I purchased my home in 2006

I attached Sweatman's side of the 1994 survey for his property. I received this via email from Sweatman in May 2020. The COB stamped this document (pg 3,4) so I believe these were all used during the COB board of appeals process and as he had several reviews with conditions for his variance application.

Was this what was used for the grant of the easement?
Yes, as mentioned above. His variance request was a rear yard setback to 25-feet. When constructed under DeKalb County, the rear yard setback was 35-feet. His COB approval had conditions including an additional approval by DeKalb county.

**Sweatman mentioned he had to gotten 2 surveys, so I am unclear if he is referring to his 1994 and then 2000, which included his 2020 update to his previous survey?


Is the fence on the northeast side the same fence that Sweatman tore down?
Yes,  the fence Sweatman tore down is on the Northeast side of my property.

Why would this survey show the fence inside the B/L?
I do not know. The attachment was done at the same timeframe by the same surveyor and shows 2746 has no fence. I also attached the faxed and time-stamped copy of my side of the 1994 survey I got from the realtors in 2006  to this email.
