Sarah,
Based on that I recommend you go forward with the survey. If it shows no encroachment then it should lead to the dismissal of plaintiff’s case and makes our claim for adverse possession moot, leaving only the balance of your claims against Sweatman. All his claims are premised on the location of the property line. If plaintiff’s claim for encroachment is dismissed, then obviously there is nothing left for the title carrier to defend.
FYI - I will be out of town through Monday.

Thanks for the response. I read your email to mean coverage would be pulled as soon as a survey was created showing no encroachment. Are you instead saying that the new survey could lead to evidence that results in the court’s dismissal of the plaintiff’s encroachment claim and that the defense obligations of Stewart will end if that is achieved?
