Please see the email chain below where plaintiff is asking for access to your property to stain and paint the fence. I assume you have no interest in allowing this access nor do I think it a good idea to allow any more money or effort to be put into a fence that we are trying to have removed. Allowing the fence to be enhanced before the court determines whether it stays or goes is inconsistent with your claims and may be seen as acquiescence to his position.

Good morning. Last week I sent a request for permission for my client and his contractor to gain temporary access to your client’s property in an effort to preserve and protect the fence. In addition to the preservation of the fence, painting and staining the fence will enhance the aesthetics of the fence for your client. In addition, I requested an update on the documents that were to be provided shortly after 4.1.22.
I have not heard back from anyone in response to both requests, other than Tania’s email below. Please provide an update on both items.
I am available to discuss the parameters around the request to paint/stain the fence, so as to maintain the peace between our clients. I appreciate someone reaching out to me this week.
